However, this condition has been strongly disrupted in the last decades with the appearance of high-rise buildings —verticalization for this research—, which is a result of a prevailing real estate model and one of the typologies of contemporary gentrification. The present article proposes to install the definition of solar access in the urban discussion, establishing its regulation as a citizen right, and to integrate it properly to a process of urban renewal that reverts the expulsion of original residents. First, the norms in our Chilean legislation regarding the direct or indirect regulation of solar access are analyzed. Then, the case of the Estación Central district is explored from a normative approach of solar access and applied to a highrise building, and complemented through participant observation and interviews with key actors of the neighborhood. As part of the main findings, it is argued that although the accelerated verticalization of Estación Central is a common practice, this situation has not been confronted as a matter of urban development. On one hand, the lack of sunning produced by a high-rise building is not really evaluated as a problem, and on the other, those who are suffering this situation are normally people without defense resources. Finally, recommendations are presented that seek to improve both, the understanding and regulation of solar access, in order to be approached as a proper urban right within the Chilean urban regulations.

Los beneficios energéticos y lumínicos de la radiación solar son algunos de los factores que mejor regulan la calidad de vida en el hábitat humano, tanto en los espacios privados como públicos. Sin embargo, esta condición está siendo fuertemente vulnerada en las últimas décadas con la aparición de edificación en altura desmedida —entendida como verticalización—, la cual es reflejo del modelo inmobiliario imperante y una de las tipologías de la gentrificación contemporánea. El presente artículo propone instalar en la discusión urbanística la definición de acceso solar, para establecer su regulación como un derecho ciudadano y con ello integrarlo adecuadamente a un proceso de renovación urbana que revierta la expulsión de residentes originarios. Para ello se analizaron los procesos de gentrificación contemporánea en Chile y las normas presentes en la legislación chilena respecto de la regulación directa o indirecta del acceso solar. A continuación, se exploró el caso de la comuna de Estación Central desde un enfoque normativo acerca del acceso solar, aplicado en un polígono con presencia de edificios en altura, análisis que fue complementado mediante la observación en terreno y entrevistas a actores clave del barrio. Dentro de los principales hallazgos se sostiene que, a pesar de que la verticalización acelerada de Estación Central es una práctica habitual, no ha sido enfrentada como un problema de desarrollo urbano. Por una parte, no se entiende la importancia de la pérdida del asoleamiento que esta produce y, por otra, los que la sufren generalmente coinciden con personas sin recursos de defensa. Finalmente, se entregan recomendaciones que pretenden avanzar en la comprensión y regulación del acceso solar, para ser abordado de manera integral como un derecho urbano, más allá de lo establecido en la respectiva normativa chilena.
