description	Although the Civil Code did not establish a legal de nition for beaches and low tide land, it did designate them as public property, whose main destination is the use of all Colombians. This rule has been developed in many times, always in the same direction. However, urban growth in these areas has been increasing, which has privileged an economic activity that sometimes goes against the sense of the rule with respect to its destination. According to the situation, this article, the result of a socio-juridical investigation in this respect, is aimed at exploring and describing the dynamics rela- ted to the urban growth of an important beach sector located in the District of Santa Marta, the area of Pozos Colorados, with the Intention to analyze the legality of the urban planning activities carried out, as well as the exercise of the powers of the authorities that must ensure their protection and control.

Si bien el Código Civil no establece una definición legal para las playas y los terrenos de bajamar, sí los señala como bienes de dominio público, cuya destinación principal es el uso de todos los colombianos. Dicha norma ha sido desarrollada con posterioridad, siempre en el mismo sentido. No obstante, el crecimiento urbanístico en estas zonas ha ido en aumento, lo cual ha privilegiado una actividad económica que, en ocasiones, va en contra del sentido de la norma con respecto a su destinación. Así las cosas, este artículo, resultado de una investigación sociojurídica, se encamina a explorar y describir la dinámica relacionada con el crecimiento urbanístico de un sector importante de playa ubicado en el Distrito de Santa Marta, la zona de Pozos Colorados, con la intención de analizar la legalidad de las actuaciones urbanísticas que se realizan allí, así como el ejercicio de las competencias de las autoridades que deben velar por su protección y control. Embora o Código Civil não estabeleceu uma de nição legal para as praias e terras maré baixa, se observou como propriedade pública, cujo destino principal é o uso de todos os colombianos. Esta regra foi regulamentada após, sempre na mesma direção. No entanto, o crescimento urbano nessas áreas aumentou, favorecendo uma actividade económica que às vezes vai contra o signi cado da regra sobre o seu destino. Assim, este artigo resultante de uma pesquisa sócio-legal sobre isso, visa explorar e descrever a dinâmica relacionada com o crescimento urbano em um setor importante da praia localizada no Distrito de Santa Marta, a área de Pozos Colorados, com pretende analisar a legalidade das acções urbanas que são executadas, e o exercício dos poderes das autoridades para garantir a sua proteção e controle.
