In Mexico, since the 2011 reforms in the field of human rights, enjoying adequate housing has become a legal obligation, but is it really guaranteed that homes have the minimum parameters to be considered adequate? Undoubtedly, infrastructure, habitability, affordability, location and the environment are some of the parameters of housing that are not always met. The purpose of this text is to contribute to the debate on the definition and scope of the right to adequate housing; as well as studying the perception of the inhabitants of the Yacatitas subdivision in Yuriria, Guanajuato, where the deficiency of the legal framework generated inadequate housing conditions, provoking the activation of legal actions to appeal the right to adequate housing in accordance with the international treaties. Tener una vivienda no es sólo una pretensión moral. En México, a partir de las reformas del año 2011 en materia de derechos humanos, disfrutar de una vivienda adecuada se convirtió en una obligación jurídica, pero, ¿realmente se garantiza que las viviendas tengan los parámetros mínimos para ser consideradas adecuadas? Sin duda la infraestructura, habitabilidad, asequibilidad, localización y el entorno son algunos de los parámetros de la vivienda que no siempre se satisfacen. Este texto tiene por objeto contribuir en el debate sobre la de nición y los alcances del derecho a una vivienda adecuada; así como estudiar la percepción de los habitantes del fraccionamiento Yacatitas en Yuriria, Guanajuato, en donde la de ciencia del marco legal generó condiciones habitacionales inadecuadas, provocando con ello la activación de acciones legales para apelar al derecho a una vivienda adecuada conforme a los tratados internacionales.
