description This paper discusses the interface between the study of urban climate and urban planning legislation, with reference to the empirical results of a survey conducted for the case of Montes Claros. To this, initially draws a quick background about the Brazilian urbanization (with focus on urban planning and legislation) aiming to elucidate the axis history-explanatory of environmental conflicts associated with the occupation of urban land. In this context, shows the paths inaugurated for the Statute of City in relation to urban sustainability and emphasize the gaps left for this with regard to the incorporation of these issues to the urban planning legislation. On the other hand, discusses the theoretical aspects of urban bioclimatology, focusing on the impacts of the occupation on the climate, especially with regard to urban heat islands. The work assumes the presupposed that there is a correlation between the urban microclimates and the variables related to the use of the urban land. Thus, was create a empirical model associating the temperature relative humidity data obtained with three parameters related to the urban use of land, chosen from the theoretical frameworks, which are: 1 - proportion of green areas and impermeable areas, 2 - constructed density, 3 - urban geometry (through the Sky View Factor). The results were analysis through the technique of linear regression and showed a high correlation between the data, especially those directly related to urban legislation: constructed density and urban geometry. The correlations found were negative for green areas and positive for impermeable areas, highlighting the importance of vegetation in the decrease of temperature and humidity in spite of its retraction in dry seasons. The results show that there is interdependence between the variables. The urban heat island identified in the city confirms the theory of the phenomenon. Finally, discusses the forms to appropriate the results to the process of urban planning.

O trabalho discute a interface entre o estudo do clima urbano e a legislação urbanística, tendo como referência empírica os resultados da pesquisa realizada para o caso de Montes Claros. Para tanto, traça-se inicialmente um breve pano de fundo acerca da urbanização brasileira (com foco no planejamento e na legislação urbanística) buscando elucidar o eixo histórico-explicativo dos conflitos ambientais associados à ocupação do solo urbano. Nesse contexto, destaca-se os caminhos abertos pelo Estatuto da Cidade em relação à sustentabilidade urbana e desperta-se para as lacunas deixadas por este no que tange a incorporação dessas questões à legislação urbanística. Em outra via, discutem-se os aspectos teóricos da bioclimatologia urbana focalizando os impactos da ocupação sobre o clima, especialmente no que se refere às ilhas de calor. O trabalho partiu da premissa de que há uma correlação entre os microclimas urbanos e as variáveis relacionadas ao uso do solo. Assim, montou-se um modelo empírico associando os dados gerados de temperatura e umidade a três parâmetros relacionados ao uso do solo, escolhidos a partir dos enquadramentos teóricos, que são: 1- proporção de áreas verdes e impermeáveis, 2- densidade construída, 3- geometria urbana (através do fator de visão de céu). Os resultados foram analisados através da técnica da regressão linear e mostraram elevada correlação entre os dados, especialmente aqueles diretamente ligados à legislação urbanística: densidade construída e geometria urbana. As correlações encontradas foram negativas para as áreas verdes e positivas para as áreas impermeáveis, o que evidencia a importância da vegetação na amenização higrotérmica apesar de sua retração nos períodos secos. Foi possível perceber que há uma grande interdependência entre os parâmetros urbanísticos analisados. A ilha de calor identificada na cidade corrobora com a abordagem teórica do fenômeno. Por fim, discute-se as formas de apropriação desses resultados ao processo de planejamento urbano.
